Terms of Service
These terms govern your use of LotProbe (the "Service"), operated by NOLKENS & CO. LLC. By using the Service or buying a report, you agree to them.
What the Service is
LotProbe compiles public records (including USGS, NYSDEC, NYC Office of Environmental Remediation, USDA-NRCS and NYC Department of City Planning data) into a map, a free risk band and paid screening reports with a 0–100 foundation risk score.
What it is not
Reports are screening tools for early due diligence and budgeting. They are not geotechnical engineering reports, environmental site assessments, surveys or professional engineering advice, and they do not satisfy NYC Department of Buildings subsurface investigation requirements (NYC Building Code Chapter 18). Subsurface conditions vary over short distances and groundwater changes with season, tides and nearby construction. Values may be estimated from records hundreds of feet away and may contain extraction errors. Foundation design and construction decisions must be based on site-specific borings and analysis by a licensed professional engineer.
No warranty
The Service and all reports are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, merchantability or fitness for a particular purpose. Source data belongs to its publishers and may be outdated or wrong.
Limitation of liability
To the fullest extent permitted by law, NOLKENS & CO. LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on a report. Our total liability for any claim relating to the Service is limited to the amount you paid for the report at issue.
Purchases
Prices are shown before you pay. Payments are processed by our card processor; we do not store card numbers. Each report is for your own use and for sharing with people working on the same property (for example your lender, broker, architect or engineer). You may not resell reports or copy the Service's data in bulk.
Acceptable use
Don't scrape, overload or attempt to break the Service, and don't use it for anything unlawful.
Changes
We may update these terms; the date above shows the latest version. Continued use means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of New York. Disputes will be resolved in the state or federal courts located in New York County, New York.
